Terms of Use

1. Subject

These terms govern the use of Auditio, an AI-powered study platform enabling course import, automatic generation of study notes, quizzes, audio podcasts, access to an AI coach, and graded mock oral exams. Any access or use of the platform implies full acceptance of these terms.

2. Access, subscription and fair use

Auditio is available through a free tier and two paid subscriptions, Auditio+ and Auditio Pro. Access by unregistered visitors is limited by a time quota to prevent abuse. The free tier gives access to course import and to the generation of study materials (notes, quizzes, flashcards) within reasonable monthly limits, together with a limited number of free trial mock oral sessions. Auditio+ gives generous access to study materials (notes, quizzes, flashcards) and the Lio AI coach, plus 20 minutes of Live mock orals per month with a maximum of 10 launches, on a fair-use basis, without audio podcasts. Auditio Pro gives generous access to every feature of the platform, including live mock orals and audio podcasts, on a fair-use basis. "Fair use" means use consistent with the normal individual study needs of a single user. To protect service quality and contain costs, Auditio applies technical safeguards (in particular on the volume of Live oral sessions, audio podcasts, and AI text generation), sized so as not to affect normal student use and to restrict only extreme, abusive, automated, or shared use. Auditio may, without refund, throttle, suspend, or terminate any account whose use is fraudulent, automated, shared between several persons, or manifestly exceeds normal individual use. Registration is reserved for persons aged 13 or over. Minors represent that they have obtained the permission of a parent or legal guardian, who accepts these terms on their behalf; where the user has not reached the digital age of consent applicable in their country of residence, parental consent is also required for the processing of their personal data.

3. Subscription and payments

Auditio+ is offered as a monthly subscription (4.99 EUR/month) or an annual subscription (39.99 EUR/year). Auditio Pro is offered as a monthly subscription (12.99 EUR/month) or an annual subscription (99.99 EUR/year), at the rates in force at the time of subscription. Both renew automatically for successive periods of the same duration until cancelled. You may cancel at any time from your account; cancellation takes effect at the end of the current paid period, with no further charge thereafter. Payments are processed by our partner Stripe; Auditio neither stores nor has access to your payment card details. Applicable taxes (VAT) are added where required. Prices may be displayed and charged in your local currency (EUR, GBP or USD); the applicable price is the one displayed at the time of subscription. Auditio may revise its prices: any change to the price of an ongoing subscription is notified by email at least 30 days before it takes effect and only applies from the next renewal. If you do not accept the new price, you may cancel before that renewal.

4. Right of withdrawal

In accordance with applicable consumer law, you have a 14-day right of withdrawal from the conclusion of the subscription. As Auditio is a digital service supplied immediately, you expressly request to benefit from it as soon as you subscribe. If you exercise your right of withdrawal during this period, you are refunded on a pro rata basis for the unused portion, the amount corresponding to the period already elapsed remaining due. You may cancel at any time from your account, with no further charge thereafter. No refund is due for an account suspended or terminated for fraudulent, automated or shared use within the meaning of article 2.

5. Auditio's intellectual property

All elements composing the platform - the Auditio brand, logo, visual identity, source code, interfaces, design, texts, pedagogical content, generated jury topics, question sets, databases, proprietary algorithms and service architecture - are the exclusive property of the publisher and are protected by Belgian and international intellectual property law, including the Belgian Code of Economic Law (Book XI). The following are strictly prohibited without prior written authorisation: total or partial reproduction, public performance, distribution, adaptation, translation, modification, creation of derivative works, substantial extraction or reuse of databases (Art. XI.306 et seq. CDE), manual or automated scraping, training of machine-learning models on any part of the content, reverse engineering, decompilation, and any commercial or competing use. Any breach results in immediate suspension of the account without notice or refund and exposes the offender to the civil and criminal remedies provided by law.

6. User-generated content

You retain full intellectual property rights over all content you create or upload via the platform (audio recordings, transcriptions, oral responses, notes, plans, study notes and quizzes generated from your courses, generated audio podcasts). To enable the service, you grant Auditio a non-exclusive, worldwide, royalty-free license strictly limited to: (a) executing the service you request (analysis, scoring, feedback generation), (b) temporarily transmitting content to our technical subcontractors (including Gemini) under contractual safeguards, (c) producing aggregated and anonymised service improvement statistics. This license ends upon deletion of content or your account, subject to a residual technical period not exceeding 24 months (consistent with the retention period in our Privacy Policy). Your content will not be used for marketing, public or promotional purposes without your express and separate consent.

7. Upload of third-party content

When you upload content of which you are not the author (course materials, notes, exam topics, book excerpts) to the platform, you represent and warrant that you hold all rights, permissions and licences necessary for its use within the service. It is strictly prohibited to upload copyrighted works, trade secrets, personal data concerning third parties, or any unlawful content, without a legitimate title. You indemnify and hold Auditio harmless from any third-party claim, action or judgment based on content you have uploaded, and undertake to bear all related costs, damages and indemnities. Any notice of alleged infringement may be sent to info@auditio.app; we apply a takedown procedure within a reasonable time after review.

8. AI-generated outputs

Feedback, scores, transcriptions, action plans, study notes, quizzes, audio podcasts and all content produced by Auditio's AI ("Outputs") are provided strictly for informational purposes, as-is, and may contain inaccuracies, biases or errors inherent to generative models. No Output constitutes professional, legal, medical, academic or official grading advice. Auditio does not claim ownership over Outputs generated in response to your content and grants you a personal, non-commercial right of use. No guarantee of success in any exam, competitive examination or assessment is offered or can be inferred from use of the service.

9. No-training commitment

Auditio makes a firm and explicit commitment not to use your imported courses, audio recordings, transcriptions, oral responses, generated study notes, quizzes, audio podcasts or any other content generated or uploaded by you to train, fine-tune or evaluate artificial intelligence models, whether proprietary Auditio models, third-party models or those of our subcontractors. We exclusively select AI provider offerings that contractually guarantee that transmitted content is not used for model training purposes ("no-training tier"). This commitment constitutes an essential clause of these terms.

10. Liability

Auditio is a preparation aid and cannot be held responsible for failure in any exam, competition or evaluation. The service is provided "as is" and "as available", without warranty of absolute availability, freedom from error or fitness for a particular purpose. To the extent permitted by law, Auditio's total liability is limited to the amount paid by the user during the twelve months preceding the triggering event.

11. Governing law and jurisdiction

These terms are governed by Belgian law, excluding its conflict-of-laws rules. Any dispute relating to their formation, interpretation or performance falls within the exclusive jurisdiction of the courts of the judicial district of Brussels, without prejudice to mandatory provisions applicable to consumers. These terms are made available in several languages for information purposes; in the event of any discrepancy, the French version prevails.
